By placing an order on the Website, you confirm that you have read and accepted these Terms.

1. Purpose

These Terms define the rights and obligations of LORYAA and the customer in connection with the online sale of products offered on the Website.

These Terms apply to all orders placed by consumers on the Website.

2. Seller Information

In accordance with applicable French consumer law, the seller provides the customer with clear pre-contractual information, including its identity, geographic address, email address, the essential characteristics of the goods, the price, delivery terms, and the existence of the right of withdrawal.

3. Products

LORYAA makes its best efforts to ensure that product descriptions, photographs, and other information are as accurate as possible. However, minor variations may exist, in particular due to screen display settings, photography, or packaging updates, and shall not affect the validity of the sale.

LORYAA reserves the right to modify the product range at any time.

4. Availability

Products are offered for sale while stocks last.

If a product becomes unavailable after an order has been placed, LORYAA will inform the customer as soon as possible by email. The customer will then be offered either a refund of the unavailable product or, where applicable, an alternative solution.

5. Prices

Prices are displayed on the Website in the currency indicated at checkout.

Unless otherwise stated, prices are shown inclusive of applicable taxes.

Delivery charges, if any, are indicated separately before the order is confirmed.

LORYAA reserves the right to modify prices at any time, but the products will be invoiced on the basis of the price in force at the time the order is validated.

6. Order Process

To place an order, the customer must:

  1. select the desired product(s);

  2. add them to the cart;

  3. complete the requested billing and delivery information;

  4. verify the order summary;

  5. accept these Terms;

  6. proceed to payment.

The sale is deemed final once the customer has completed the order process and received an order confirmation email, subject to payment validation.

LORYAA reserves the right to refuse or cancel any order for legitimate reasons, including in the event of suspected fraud, payment incident, abnormal order volume, or prior dispute with the customer.

7. Payment

Payment is due in full at the time the order is placed.

The payment methods accepted on the Website are those indicated at checkout.

The customer guarantees that they are fully authorized to use the payment method chosen.

LORYAA reserves the right to suspend or cancel any order and/or delivery in the event of non-payment, payment refusal by the payment provider, or suspected fraud.

8. Order Confirmation

Once payment has been validated, the customer will receive an email acknowledging receipt of the order.

This email confirms that the order has been received by LORYAA but does not prejudice LORYAA’s right to cancel the order for legitimate reasons as stated in these Terms.

The customer is responsible for checking the accuracy of the information provided in the confirmation email and for contacting LORYAA promptly in the event of any error.

9. Delivery

Products are delivered to the address provided by the customer during the order process.

Estimated delivery times are indicated on the Website and/or at checkout. These timeframes are indicative unless mandatory law provides otherwise.

LORYAA shall not be liable for delivery delays caused by the carrier, customs, force majeure, or any circumstance beyond its reasonable control.

The customer is responsible for providing accurate and complete delivery information. Any additional costs arising from incorrect or incomplete delivery details may be charged to the customer where legally permitted.

10. Receipt of Products

Upon delivery, the customer is encouraged to inspect the package and products.

If the package appears damaged, or if the delivered product is defective, missing, or incorrect, the customer should contact LORYAA as soon as possible at contactloryaa@gmail.com, providing any useful supporting information, including photographs where relevant.

11. Right of Withdrawal

For consumers purchasing at a distance, French consumer law generally provides a 14-day right of withdrawal, without having to state any reason, from the day the customer or a third party designated by the customer receives the goods.

To exercise this right, the customer must notify LORYAA by email at contactloryaa@gmail.com before the expiry of the withdrawal period by means of an unambiguous statement.

The customer must return the goods without undue delay and in accordance with applicable law.

Unless the return is due to an error by LORYAA or unless applicable law provides otherwise, the direct cost of returning the goods is borne by the customer.

The customer may be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods.

12. Refund Following Withdrawal

Where the customer validly exercises the legal right of withdrawal, LORYAA will reimburse all sums due in accordance with applicable law, including standard delivery costs where required.

Under French consumer rules, the refund must generally be made within 14 days from the date on which the seller is informed of the customer’s decision to withdraw, although reimbursement may be deferred until the goods are recovered or the customer provides proof of shipment, depending on the circumstances.

Refunds will be made using the same means of payment used for the original transaction, unless expressly agreed otherwise.

13. Exceptions to the Right of Withdrawal

In accordance with applicable law, the right of withdrawal may not apply in particular to:

  • personalized or custom-made goods;

  • sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed;

  • goods that, after delivery, are inseparably mixed with other items;

  • any other goods or services excluded by mandatory law.

14. Commercial Return Policy

In addition to any mandatory legal rights, LORYAA may offer a commercial return or refund policy, as described separately on the Website.

Where applicable, any such commercial policy is independent from and does not limit the customer’s statutory rights.

If LORYAA applies the 30-day “Satisfied or Refunded” policy, the product must be returned unused, in its original packaging, and in suitable resale condition, in accordance with the return policy published on the Website.

15. Legal Guarantee of Conformity

Under French consumer law, the seller must deliver goods that conform to the contract and is liable for conformity defects existing at the time of delivery that appear within two years from delivery. In case of lack of conformity, the consumer may be entitled to repair or replacement, or failing that, a price reduction or termination of the contract under the legal conditions.

This legal guarantee applies independently of any commercial warranty.

16. Hidden Defects

The customer may also benefit from the legal warranty against hidden defects under the conditions provided by applicable law.

17. Liability

LORYAA shall not be liable for any indirect, incidental, or consequential damages, except where such limitation is prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including consumer rights under applicable French and EU law.

18. Force Majeure

LORYAA shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from an event beyond its reasonable control, including but not limited to natural disaster, epidemic, strike, internet outage, carrier disruption, war, governmental action, or supply chain disruption.

19. Intellectual Property

All elements of the Website, including but not limited to text, images, logos, designs, graphics, trademarks, and content, are protected by intellectual property rights.

Any reproduction, representation, distribution, or exploitation of all or part of the Website without prior written authorization from LORYAA is prohibited.

If no amicable solution can be found, disputes may be submitted to the competent courts in accordance with applicable law.

Where mandatory consumer law applies, the customer retains the right to rely on any jurisdiction rules that protect consumers.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

LORYAA reserves the right to amend these Terms at any time.
